Please read these Terms and Conditions of Use carefully. You are agreeing to the terms and conditions listed below. Our phone conversations are recorded and you are agreeing to a verbal contract. Please note that Dor-Mar reserves the right to modify, amend, add or remove any portion of these Terms and Conditions at our sole discretion. Please review these Terms and Conditions regularly on our website at DormarHVAC.com.

CREDIT CARDS

Dor-Mar takes the protection of your personal information very seriously. Please be aware that your credit card information or check information may be subject to additional security measures. Routine Maintenance Schedules Your Safety Inspection(s) on your equipment will be covered for a period of 12 months beginning on the day on which this form is printed. These Safety Inspections(s) will be performed on your equipment at Dor-Mar’s time frame. We will use your information for our internal use only and will not share your information with any third party. MONTHLY Membership – By opening a membership with us, you agree to pay all fees (including applicable taxes) to your account in accordance with the terms and conditions in effect at the date the charge becomes due. We reserve the right to vary the amount or basis on which any fees or charges are determined and to institute new charges, charges or terms only on the date of your annual renewal.

Membership

Your MONTHLY membership is a 12-month agreement. It is automatically renewed each year and your credit card is charged each month, unless you cancel your subscription before the renewal date. You may cancel your membership by sending a letter to the following address: Dor-Mar, 228 E Main St, Newark, Ohio 43055

You have signed up for ANNUAL membership for 12 months. You will receive an ANNUAL renewal letter approximately 45 days before your membership renewal date. Unless you cancel your membership before that date, you may cancel your membership by mail to: Dor-Mar HVAC, 228 E. Main St, Newark, Ohio 43055. When you request termination, you do not receive a refund of any unused portion of your current club membership. In the event that your services rendered or discounts exceed your payments, you agree to pay Dor-Mar in full before you cancel your membership. You acknowledge and agree that Dor-Mar may continue to charge you for services automatically until all charges are paid in full. This Agreement may only be transferred with the express written consent of “Dor-Mar”. Your right to service shall be subject to any limits set by Dor-Mar or by the credit card issuer of your choice. If payment cannot be made to your credit card, or if the charge is returned to you for any reason including chargeback, this Agreement and all of Dor-Mar’s obligations shall terminate.

Liability Limitations

WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONVENTIONAL, SPECIAL, OR UNCOUNTED DAMAGES RESULTING FROM THE USE OF, OR THE LOSS OF, SERVICES PROVIDED UNDER THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO, BUT NOT LIMITED TO: · MINIMUM DAMAGES RESULTED FROM THE USE OF SERVICES PROVIDED ONCE YOU SUCCEEDED WITH THE USE OF THE SERVICES PROVIDED AS A PART OF THIS AGREEMENT. LIMITATIONS AND EXCLUSIONS Law applicable to you may not permit the limitation or limitation of incidental or consequential damages. In any event, our total liability for any damages, losses, or causes of action (negligence, contract, tort, or otherwise) exceeds the amount you paid for your club membership, if any.

TERMINATION

This Agreement is for a period of 12 months. Monthly memberships will automatically renew unless you cancel the subscription before the expiration date. Annual memberships will not automatically expire.
